Is Divorce Mediation a Good Idea?

Divorce mediation is an outstanding option to seriously consider when going through the divorce process.  This is especially true if you have children.  One of the major pitfalls associated with a litigated divorce is the emotional scarring that will remain for years to come afterwards.  It is not uncommon for one or both parties to become estranged from their children subsequent to a divorce battle.  This results from the fact that the children have been brought into the process and have been adversely affected by it.

When getting divorced one must never lose sight of the fact that the children have done nothing wrong.  It is not fair to them to have the two people who love them the most to have a completely dysfunctional relationship.

For their sake, the divorce mediation process should seriously be considered.  Divorce mediation is a civilized way to get divorced.  A neutral third party, the mediator, assists the parties in managing all issues and coming to an amicable resolution.  There is typically no name calling, no lawyer involvement during the negotiation which can sometimes makes bad situations even more litigious. 

People forget that when they are going through a divorce at one time they cared very much for the other person and in all likelihood their children still care about the other person very much.  Why not take a chance at trying to resolve everything in an amicable fashion.  If the divorce mediation process does not work the parties can always resort to litigation at a later time.  There is nothing to lose by trying to get divorced the right way.

There are other advantages to the mediation process.   One being the extremely reasonable cost associated with it.  Most divorce mediations conducted by the law firm of Villani and Deluca are completed with an aggregate cost of under $2,500.00.  That is substantially less than the initial upfront retainer required by both divorce lawyers.  In the Central New Jersey, Jersey Shore area most divorce lawyers ask for a $5,000.00 upfront retainer.  If you and your spouse elect to retain lawyers that could be a $10,000.00 expenditure before the lawyers even say hello to one another.
