Understanding Your Surf City Municipal Court Summons

Surf City Municipal Court is a court of limited jurisdiction, meaning that it primarily handles offenses occurring within its own municipal borders. Cases heard at Surf City Municipal Court mostly involve motor vehicle offenses, municipal ordinance violations, DWI charges and minor criminal offenses.

Certain offenses are payable, meaning that if you wish to plead guilty, you can settle your charges by paying the stated fine amount.  However, you may still choose to appear in court even if you are not mandated to do so.  Other offenses require a court appearance, which will be indicated by a checkmark in the “court appearance required” box on your summons.

If you wish to plead not guilty, you must call the court office at least 7 days before your court date.  If you fail to do so, you may have to come back on a separate court date, since the prosecutor may not be ready to try your case.

Surf City Municipal Court holds sessions on the first Tuesday of each month, except during January, November and December, due to the holiday season.  Court hearings begin at 11:00 a.m., with an opening statement by Judge James A. Ligouri.

The court office of Surf City Municipal Court is managed by Court Administrator, Constance L. Motter.  Ms. Motter can be reached during the court office’s business hours, which are Monday to Friday, 9:00 a.m. to 1:00 p.m. and 2:00 p.m. to 4:00 p.m.

In addition to entering in not guilty pleas for upcoming court dates, the Court Administrator can also answer questions about your summons. She can also assist you with administrative tasks such as filling out court forms.

However, the Court Administrator does not have the power to change a judge’s orders, nor can she speak to the judge or prosecutor on your behalf.  In addition, she cannot offer legal advice or advise you on the possible outcomes of taking your case to trial.
