Divorce

There are a number of different ways to obtain a divorce in New Jersey. Divorces can proceed in either a contested or uncontested manner. A contested divorce typically requires Court involvement. Contested divorces take longer than uncontested divorces and usually cost more money. Under New Jersey Law when a couple divorces, the spouse who earns more money may have to pay support to the spouse who earns less. Alimony is determined by the Courts by evaluating the following: the actual need and ability of the spouse to pay, the length of the marriage, the ages of the parties, the physical and mental health of the parties, the standard of living that was enjoyed during the marriage, the earning capacities of the parties, etc. There is no set formula utilized in the calculation of alimony. Child Custody and Visitation Rights

Child Custody determinations in New Jersey are governed by what is known as the child's best interests standard. In determining what is in the best interests of the child the following factors are examined; the age of the child, each parent's living situation, each parents willingness to support the other's relationship with the children, the child's preference (if the child is over 12), continuity and stability, etc. There are two types of custody, which are legal and residential. Normally the parties to a divorce will share joint legal custody. This means they will each have an equal say in all major decisions such as the choice of school for the child, medical decisions pertaining to the child, etc. Residential custody is oftentimes contested in a divorce proceeding. Residential custody refers to where the child will live subsequent to the divorce being finalized.

Child Support

Child support is calculated in a New Jersey Divorce by utilizing the Child Support Guidelines that have been established by the Supreme Court of New Jersey. Child support is based on a percentage of both parties' income, utilizing a percentage of the combined income to determine each parent's share of the child support amount. Child support is paid until such time as the child is emancipated. The child is entitled to enjoy the good fortune of his or her parents. Should their respective salaries increase after the divorce, the amount of child support may correspondingly increase as well.

Collaborative Divorce

A collaborative divorce is a divorce that allows couples to negotiate all aspects of the divorce without court involvement. The parties to a collaborative divorce sign a participation agreement which is a pledge to not go to court at the commencement of the process. The couple engages in a series of meetings with the mediator who acts as a facilitator in assisting the couple going through the divorce in resolving all of their issues.
