Monmouth County Court System

Within the Monmouth County court system, there are several sections of its civil division: general equity, law division, small claims (demands that are less than $3,000), landlord/tenant and the special civil part. If demands are over $15,000 then the case would be filed in the Law Division of the Superior Court. There is no monetary limitation for cases filed in the Law Division.

There is also a criminal division, family division, municipal division and a probation division. The family division processes divorce, nullity, and separate maintenance issues, as well as addressing paternity, child support, spousal support, termination of parental rights, abuse and neglect, and other family-related issues such as domestic violence and juvenile delinquency. The criminal division maintains and coordinates the criminal court system and determines eligibility for public defender services as well as admission into Pre-Trial Intervention (PTI) programs and bail reduction considerations. This division also operates a drug court to deal with non-violent drug-related cases and administers alternatives to formal sentencing, allowing offenders to enter treatment programs as opposed to incarceration. Finally, the probation division is responsible for enforcing orders from criminal, family, and municipal divisions related to adult and juvenile supervision and child support enforcement.
