NJ Personal Injury: Bill Approved Limiting Access to Car Black Boxes

A bill has been passed by the New Jersey Assembly that is designed to limit third-party access to event data recorders, or, as they are sometimes called, “black boxes” in order to protect the rights of car owners. The State Assembly passed bill A3579 unanimously (68-0) on Dec. 18, 2014.

Car manufacturers are required by law to include event data recorders (EDRs) in automobiles, according to the National Highway Traffic Safety Administration. However, there are currently no laws that dictate to whom the information collected by the EDRs belongs. This new bill would mean that the information collected would belong to the owner of the vehicle, not the manufacturer. It would also make it more difficult for third parties like law enforcement, insurance providers and claimants in civil issues to access the information.

What This Means for You

This bill could greatly affect the outcome of a civil suit in New Jersey. Personal injury cases in particular could be affected. For instance, if you are injured in a car accident because of somebody else's negligent driving, you may want to seek compensation through a NJ personal injury lawsuit. A car's “black box” can be a helpful tool during the suit to prove negligence. But, if this new bill passes, information like the vehicle's speed, location time of use and then number of people inside the vehicle at the time of the accident that is recorded by the EDR will not be permissible in court.
If the bill passes, law enforcement would only have access to the EDR with a warrant or if the owner of the vehicle gave permission. Auto repair shops would also have the ability to download the EDR with the permission of the owner of the vehicle.
