Q) Can I go to jail for leaving the scene of a car accident?
A) Yes you could. As a crime of the third degree in New Jersey, leaving the scene of an accident can result in a charge for aggravated assault or assault by auto if the accident caused serious bodily injury to another person. Regardless of your knowledge of the serious injury prior to leaving the accident, if convicted of the crime charged, the court has the discretion to impose a sentence of imprisonment.
