Arrested for an Ecstasy Charge in NJ?

ecstasy

In the past fifteen to twenty years, our society has seen a marked increase in the use of “club drugs”. Ecstasy has been one of the mind-altering drugs of choice and therefore is in high demand. Ecstasy has reportedly been found near Asbury Park and the local clubs in Belmar, Long Branch and Brick. It is a commonly used drug, especially with a younger club crowd, or with people who may simply be in the wrong place at the wrong time.
The demand for Ecstasy is growing each year. With this demand comes an increase in the number of people charged with Ecstasy possession or distribution. If you were partying at Bamboo in Seaside Heights or any South Jersey club and got charged with Ecstasy possession or distribution, call Villani & DeLuca today for advice from one of our NJ Ecstasy Possession Lawyers.

Basic Facts on Ecstasy

Ecstasy is a mind-altering drug that is used for its psychedelic and stimulant properties. In clubs and on the streets it has any number of aliases, such as “x” or “Molly”. In Long Branch it might be called XTC or the Hug Drug, while in Toms River a buyer might ask for The Love Drug, The Designer Drug or Disco Biscuits. No matter what the nickname, all contain methylene dioxy methamphetamine (MDMA), which is the active ingredient in Ecstasy that the police will be testing for.
Ecstasy is a man-made drug not found naturally in the environment. It was used legally until 1985, and its primary use for most of that time was to treat people who suffered from post-traumatic stress disorder. It was used in that way for its properties as a stimulant. After 1985, it was taken off the legal market and sometime later it began appearing on streets, gaining a following until it became a club drug of choice.

NJ Penalties for Distribution or Possession of Ecstasy

In NJ, the charge of possession or distribution of the drug Molly, or any other form of Ecstasy, is a very serious drug charge. Both charges can lead to jail time. If you live in the Monmouth or Ocean County areas and have been charged with one of these offenses, contact the NJ Ecstasy Possession Lawyers at Villani & DeLuca to discuss your options.
The penalties involved with the charges vary depending on how much Ecstasy you have in your possession when you are searched. If you have five ounces or more, you are charged with a first degree crime and can face up to 20 years in prison and a fine of $500,000. A half ounce to five ounces is a crime of the second degree and carries a maximum 10 years in prison and a fine of $100,000. One half ounce or less is a third degree crime and you could see 5 years in prison for this offense and a fine of $75,000.
In addition to the above charges for possession of Ecstasy, if you are caught with it and intent to distribute can be proven, you can face $500,000 in additional fines after the ones listed above.  You may not be eligible for parole for the jail times listed above. Distribution of Ecstasy is an extremely serious offense.
