Q) What are some of the advantages and disadvantages of obtaining a custody order?
A) Some people decide not to get a custody order because they do not want to get the courts involved. They may have an informal agreement that works well for them or may think going to court will provoke the other parent. Getting a custody order can provide you with:
- The legal right to make decisions about your child.
- The legal right to have your child live with you.
- If you decide not to obtain a custody order, then legally, you and the other parent both have equal rights to make decisions about your child and live with your child. The only way to legally change this arrangement is to file for custody.
