Length of the Divorce Process
A divorce is like a snowflake, in that each are unlike any other of their kind. The number of unique factors in each divorce proceeding means that there is no hard and fast answer to the question of how long any particular divorce proceeding will take. Nevertheless, certain broad predictions, based on experience, can be made with some confidence.
It should hardly be surprising, for example, that a divorce proceeding where the parties agree on the equitable division of property and all other issues will likely be concluded before a divorce where the parties do not agree on the equitable division of property. In the first case, the parties may see a conclusion to the proceeding in three to four months; a period of time that is largely a function of waiting for the date of the court-scheduled uncontested hearing to arrive, at which the court will enter the divorce judgment. In the latter case, however, where equitable division of property or other issues are in contention, a divorce proceeding can take from several months to- believe it or not- several years.
Many Factors Influence Length
Although court backlogs do figure into the time it takes to conclude a divorce action, the major factor will always be the amount of agreement between the parties: in general, the fewer things that are in contention between the parties, the quicker the divorce proceeding will be concluded.
Obtaining a Quick Divorce Should Not be Your Only Focus
Nothing is more understandable than the desire of a party to a divorce proceeding to see that proceeding concluded. Of course, speed of conclusion is only one of many considerations you should have in mind if you are getting divorced in New Jersey.
